UN Human Rights Committee: Concluding Observations on Bolivia (1997)

In the concluding observations on the second periodic report of Bolivia, the Committee addressed the issue of non-compliance of the Coca and Controlled Substances Act with the ICCPR relating to the principles of fair trial, including presumption of innocence, right to defense, right to appeal, and freedom from inhumane treatment of accused persons. The Committee noted in particular the severity of restrictions to release suspects on bail under the Act and the lack of judicial control over the investigation of drug related crimes. The Committee recommended the law be reviewed and revised to be compliant with the Covenant.
