Case Of The Xákmok Kásek Indigenous Community V. Paraguay (Merits, Reparations, Costs) IACtHR (24 August 2010) Series C No 214

The Xákmok Kásek Indigenous Community in Paraguay suffered from dispossession of their ancestral lands which conflicted with private ownership of farmland.  The community additionally suffered from high rates of malnutrition and preventable deaths—mostly children--because of lack of adequate resources including medicines.  The Court held the government responsible under the Covenant for its failure to ensure the community was able to access health services and provide necessary medicines.  Violations of the right to life, rights of the child and right to non-discrimination were upheld in addition to other rights unrelated to access to medicine.
