Hanif and Khan v the United Kingdom (Apps no 5299/08 and 61779/08) ECHR 20 December 2011

The applicants Ilyas Hanif and Bakish Allah Khan, are British nationals who were born in 1967 and 1978 respectively. They were both convicted in January 2007 of conspiracy to supply heroin. At the time of lodging his application, Mr Hanif was serving an eight year prison sentence in HM Prison Moorlands; Mr Khan is currently serving a 15-year sentence in HM Prison Dovegate. Relying on Article 6 § 1 (right to a fair trial), they allege that their trial was not fair because there was a police officer on the jury which convicted them.
