Kiyutin v Russia (App no 2700/10) ECHR 10 March 2011

The applicant, Viktor Kiyutin, was born in the Uzbek SSR of the Soviet Union in 1971 and acquired citizenship of Uzbekistan upon the collapse of the USSR. He has been living in the Oryol Region of Russia since 2003 and is married to a Russian national. The case concerns the authorities’ refusal to grant Mr Kiyutin a Russian residence permit because he is HIV positive. He relies in particular on Article 14 (prohibition of discrimination) in conjunction with Article 8 (right to respect for private and family life and the home).
