Kozokhar v Russia (App no 33099/08) ECHR 16 December 2010

The applicant, Vladimir Kozhokar, is a Russian national who was born in 1980 and is currently serving a prison sentence in correctional colony no. 7 in the Tula Region (Russia). Relying on Articles 3 (prohibition of inhuman or degrading treatment) and 13(right to an effective remedy), he complained of having been remanded in overcrowded cells during criminal proceedings brought against him for drug trafficking, and that he had not had adequate remedies at his disposal to complain before Russian courts about the inhuman conditions of his detention. HIV-positive, he also complained under Article 3 of the allegedly inadequate medical assistance afforded to him during his detention in remand.
