Umirov v Russia (App no 17455/11) ECHR 18 September 2012

The applicant, Sadirbek Umirov, is an Uzbek national who was born in 1981 and lives in Moscow. In September 2009 he left Uzbekistan for Russia where he settled in the Moscow region. On a wanted list in Uzbekistan for being a member of the Warriors of Islam, considered an extremist religious organisation by the Uzbek authorities, he was arrested in Krasngorsk (Russia) in May 2010 and extradition proceedings were launched against him. He was released in November 2011 as the maximum statutory period of 18 months had expired. He was granted temporary asylum in June 2012 pending the European Court’s judgment. Relying in particular on Article 3 (prohibition of inhuman and degrading treatment), he alleged that, if extradited to Uzbekistan, he would be at real risk of persecution and ill-treatment given the charges against him. Lastly, he also complained under Article 5 § 1 (right to liberty and security) about in particular the length of his ensuing detention pending extradition from May 2010 to November 2011.
