Garcia Alva v Germany, ECHR (2001)

The applicant is a Peruvian citizen, born in 1964. When lodging his application, he was detained in a prison in Berlin. In 1993 he was arrested on allegations of drug-related offenses. The case concerns the applicant's complaint that, in the proceedings for the review of his detention on remand, his defence counsel had no access to the criminal files.  The applicant invokes Article 5 para. 4 of the Convention.
