Jorge Odir Miranda Cortez et. al. v. El Salvador (Report) IACHR (20 March 2009) Report No. 27/09

Jorge Odir Miranda Cortez along with 26 other petitioners were HIV positive in the terminal stages of the disease when they sought triple viral treatment therapy from the government.  The State required petitions through the Court system which were found to be unduly prolonged.  Following the Commissions request for precautionary measures, the State provided treatment to those applicants still living (three having died prior).  The Commission found the State to be in violation of the Covenant for their failure to provide effective judicial protection and non-discriminatory treatment of those with HIV/AIDS.
