Bolivar Franco Comancho Arboleda v. Ecuador, IACHR (1997)

Mr. Comancho Arboleda, an Ecuadorian national, was detained by police for possession of cocaine and held for 5 years without court resolution of the charges.  The charges were dismissed 5 years and three months after his detention.  Because the criminal procedure does not permit a remedy for arbitrary deprivation following the dismissal of charges, the Commission granted the case admissible before them and recommended a friendly settlement.
