Pakhomov v. Russia (App no 44917/08) ECHR 30 September 2010

The applicant, Anton Pakhomov, is a Russian national who was born in 1980 and lives in Artyom (Primorye Region, Russia). The case concerns Mr Pakhomov’s allegation that his conviction and sentencing to eight years’ imprisonment in December 2007 for drug trafficking was based on statements by witnesses he had been unable to confront in open court, in breach of Article 6.1 (right to a fair trial). In supervisory review proceedings in January 2010 he was acquitted of the trafficking charge and released. Further relying on Article 3 (prohibition of inhuman or degrading treatment), the applicant, who suffers from tuberculosis, also complains about the inadequacy of the medical care during his imprisonment.
