Pesukic v Switzerland (App no 25088/07) ECHR 6 December 2012

The applicant, Srdan Pesukic, is a Montenegrin national who was born in 1974 and is currently detained in a cantonal prison in Regensdorf (Switzerland) for drug-related offences. Relying on Article 6 §§ 1 and 3 (d) (right to a fair trial / right to obtain attendance and examination of witnesses), Mr Pesukic complains about the unfairness of his conviction of manslaughter and drug-trafficking in February 2004. Notably he alleges that his conviction was based to a decisive degree on the testimony given by an anonymous witness.
