Erkapic v Croatia, ECHR (2013)

The applicant, Mario Erkapić, is a Croatian national who was born in 1967 and lives in Zagreb. The case concerns Mr Erkapić’s complaint about the unfairness of criminal proceedings brought against him for heroin trafficking in Zagreb. He notably alleges that his conviction in April 2005 of conspiracy to supply heroin was based to a decisive extent on oral statements made by his co-accused, heroin addicts going through withdrawal, who alleged that they had been ill-treated by the police during their questioning about the trafficking ring. Mr Erkapić relies on Article 6 § 1 (right to a fair trial).
