Novikov v Russia, ECHR (2013)

The applicant, Aleksandr Novikov, is a Russian national, born in 1963, who is currently serving a prison sentence. In April 2002, he was placed in detention pending trial on charges of, in particular, selling drugs, of which the courts convicted him in November 2005 and sentenced him to eight years’ imprisonment. Relying on Article 5 § 3 (right to liberty and security / entitlement to trial within a reasonable time or to release pending trial), he complains that the duration of his detention pending trial was excessive and unjustified. Relying further on Article 6 § 1 (right to a fair trial within a reasonable time), he complains that the criminal proceedings against him were excessively lengthy.
