Report of the Working Group on Arbitrary Detention: Mission to Malaysia (2011)

This report presents the findings and recommendations of the Working Group on its mission to Malaysia.

It expresses concerns in relation to several convict prisoners found guilty of drug trafficking and possession who had been caned. It also notes that many people are detained under the Dangerous Drugs Act which hinders the human rights guarantees of individuals. The Working Group recommends the Government to abrogate this preventive law as it impedes the detainee’s right to a fair trial and restrict their access to legal counsel.
